South Australian Premier Mike Rann has announced that if reelected, his government will amend the 1921 Evidence Act and provide juries with the criminal history of defendants. Premier Rann says the legal system is “stacked in favor of criminals,” but civil libertarians and lawyers say the move will undermine the presumption of innocence. With less than two weeks until the SA election, the polls show the Liberals have drawn level with the government. But should the basis of the South Australian legal system hinge on an election?
