Iranian refugee Abbas al-Kafaji is on his way back to Baxter Detention Centre today after almost two years of freedom. He was freed in 2002 when the Federal Court said the government did not have the power to keep refugees in detention indefinitely, even though Mr al-Kafaji’s refugee status was proving impossible to determine. A High Court decision this morning has overruled that decision. Lawyer for Mr al-Kafaji Jeremy Moore says the ball is now back in the government’s court to change their policies on detention.
