Race-based discounts in Australia’s justice system?

For the first time in 30 years, the High Court is considering whether someone’s race can be used as a defence in sentencing. The High Court heard the case of William Bugmy today. Mr Bugmy has been in and out of jail over the last 15 years but today’s case asked the question, ‘Should someone’s Aboriginality be considered as a defence when being sentenced in court?’

Debate over special considerations for Aboriginal people in court sentencing has been subject to controversy and we speak to Mr Bugmy’s lawyer as to why this change should occur.
