There has been a long-standing debate over whether humans really are responsible for their actions – whether we have free will – or whether there are factors outside of our control that shape how we will act.

As new research and theories come to light on the matter of free will, this raises concerns about potential rammifications to the criminal justice system.

Some experts suggest that even if the idea of free will is debunked, the retributive aims of the criminal justice system will continue to punish offenders, even if they are not responsible for their actions.
